In such cases, it shall be ensured that the details of outward supplies pertaining to the relevant category are furnished exclusively in the respective statement, namely Statement 1A or Statement 1B. Part II — Detailed description and analysis (editorial explanation)

This explanatory section is not part of the Gazette notification. It summarises the principal provisions in the uploaded 98-page Notification No. 05/2026–Central Tax, dated 26 October 2026, issued by the Central Board of Indirect Taxes and Customs under section 164 of the CGST Act, 2017. Readers should consult the full text above for precise legal wording, exceptions, forms and transitional dates.

1. Notification overview and commencement

The notification names the Central Goods and Services Tax (Amendment) Rules, 2026. Its general commencement date is 1 November 2026, except where individual amendments specify another date. Important separate dates appearing in the text include 1 December 2026, 1 January 2027 and 1 April 2027. A single implementation date must therefore not be assumed for every provision.

2. New Rule 14B: e-commerce warehouse-based registration

New rule 14B provides an option for qualifying suppliers of goods through electronic commerce operators (ECOs) required to collect tax at source under section 52. A person registered in a home State or Union territory may seek registration in another State or Union territory without physical presence there by declaring an ECO warehouse as the principal place of business, subject to specified conditions.

  • The applicant must intend to supply goods through a qualifying ECO and obtain the operator’s consent for use of its warehouse address.
  • The rule specifies a monthly output-tax-liability ceiling of ?2,50,000 on the described supplies to registered persons, with exclusions stated in the rule. This is an output-tax test, not a sales-turnover ceiling.
  • The applicant uses FORM GST REG-01 and provides its existing home-State GSTIN; the ECO has seven working days to give consent.
  • Biometric Aadhaar authentication, document verification and home-State physical verification may apply, with specific deemed approval and rejection provisions.
  • Changes to warehouse details and withdrawals of consent can require FORM GST REG-14 within the stated thirty-day periods; failure may lead to deletion of a place of business or cancellation of registration.
  • The rule addresses records, home-State registration, opting out through FORM GST REG-32, and restrictions on multiple registrations under the same PAN in the same State or Union territory.

3. Amendment of registration — Rule 19

The substituted rule 19 sets out the procedure for updating registration particulars, including FORM GST REG-14 applications, supporting documents, officer scrutiny of principal-place changes, notices and replies. The text generally requires reporting changes within fifteen days and specifies time limits for decisions and deemed amendments. Rule 19(3) has a separately specified commencement date of 1 December 2026.

4. Taxpayer-requested cancellation — Rule 20

The substituted rule 20 sets out a fuller cancellation process, including FORM GST REG-16, filing of relevant returns and settlement of liabilities, suspension while proceedings are pending, system-based cancellation in specified cases, officer review, notices, replies and possible revision of the effective cancellation date. Taxpayers contemplating closure should reconcile outstanding returns, tax, interest and other dues before applying.

5. Cancellation, suspension and restoration of registration

The notification also substitutes rule 21 (specified grounds for cancellation), rule 21A (suspension) and rule 22 (cancellation proceedings), and inserts rule 23A (system-based revocation). The substituted rules 21A and 22 and new rule 23A are expressly scheduled for 1 April 2027. These provisions introduce electronic workflows, including system-generated communications, compliance windows and a route to seek revocation within 180 days in specified cases.

6. Input Service Distributor and input tax credit changes

Changes to rules 36, 39, 54 and 60 address documentation, distribution or transfer of input tax credit relating to the Input Service Distributor (ISD) mechanism, including terminology and reporting in FORM GSTR-6A. Businesses using multiple GST registrations should examine the impact on inter-entity service-credit documentation and allocation.

7. Refund procedures and electronic credit ledger

The amendments to rules 86, 86A, 89, 90, 91 and 92 address refund claims, debit of the electronic credit ledger, restrictions on ledger debit, acknowledgement of refund applications, provisional refunds and refund payment orders. Rule 86A changes, including specified objection and order forms, are scheduled for 1 April 2027. The text provides a ten-day refund-application acknowledgement/deficiency framework under rule 90 and a deemed-acknowledgement mechanism where the prescribed action is not taken.

Rule 89 includes detailed changes to documentary evidence, electronic-ledger debit sequencing, zero-rated supplies and inverted-duty refund computations. Some capital-goods credit provisions have a later commencement date. Refund calculations should be checked against the exact rule and applicable effective date before claims are prepared.

8. Other procedural and form changes

The notification also amends rules concerning composition-taxpayer reporting, GST practitioners, e-way bills for metro railway movement and certain recovery/attachment processes. It substitutes or modifies a substantial number of GST forms, tables, instructions and annexures. The later pages of the 98-page document contain extensive prescribed form layouts and fields; these should be consulted directly when updating filing templates or software.

9. Key implementation dates

DateSignificance
26 October 2026 Notification issued.
1 November 2026 General commencement, except provisions with specific dates; certain rules expressly commence on this date.
1 December 2026 Certain amendments including rule 19(3), rule 44 and specified rule 89 changes.
1 January 2027 Specified FORM GST INV-01 schema changes described in the notification.
1 April 2027 Specified registration suspension/cancellation/revocation and credit/refund amendments, including rules 21A, 22, 23A and 86A.

10. Practical impact on businesses

  • Online sellers using third-party fulfilment warehouses should assess eligibility for the new rule 14B registration route and coordinate ECO consent and warehouse details.
  • GST registration teams should update their procedures for changes in business addresses, authorised signatories and other particulars.
  • Businesses closing registrations should reconcile return filing and outstanding liabilities before applying for cancellation.
  • Tax and finance teams should review refund documentation, ledger debits and eligibility computations in light of the amended rules.
  • Software and compliance teams should track revised GST forms and their separate commencement dates rather than applying all changes at once.

11. Accounting software and TallyPrime considerations

Businesses using TallyPrime or other accounting software should review GST master data, GSTINs and warehouse addresses; reconcile outward supplies and input tax credit; maintain refund-supporting invoice records; and coordinate any revised return or form workflows with their tax advisers. The notification does not itself certify that any specific software version supports the newly prescribed forms. Availability of features and statutory updates should be confirmed with the software provider.

12. Illustrative scenarios

Example A — An online seller registered in one State wants to store goods at an ECO warehouse in another State where it has no physical premises. The seller should assess rule 14B eligibility, the output-tax threshold and the ECO-consent process before seeking registration.

Example B — A registered business plans to close operations. Before requesting cancellation, its finance team should check pending GSTR-1/GSTR-3B or other applicable returns, stock and capital-goods liability disclosures and amounts payable under the substituted rule 20.

Example C — A business filing an ITC refund should review amended rule 89 documentation and debit sequencing, and check whether any capital-goods or inverted-duty changes apply to the relevant claim period.
