India Bull Co charges 4.5 Crore service tax on fake registration number

Service Tax Department has issued a Show Cause notice demanding service tax of Rs 4.5 to MMPL(Mackennas Minerals Private Limited), New Delhi, a family concern of India Bull Group owned by Shri Narender Gehlawat.

MMPL was found engaged in the business of soil excavation and earth removing work.  MMPL provided the services of soil excavation to India Bulls Properties Private Limited at their site Jupiter Mill in Mumbai and raised invoices charging soil excavation charges and Service Tax.  Investigation disclosed that fictitious Service Tax Registration number had been mentioned on all the invoices raised by the MMPL to IBPPL

However, they had neither applied for Service Tax Registration and nor filed any service tax returns with the Department nor paid any Service Tax. Further, it was also found by service tax department that they had received about Rs 37 crores as excavation charges and Service Tax amounting to four and half crores from IBPPL.

During investigation, MMPL admitted their liability and paid the service tax along with Interest of 13 per cent.
