UPON hearing the counsel the Court made the following
O R D E R
W.P.(C)No.377/2018 :
1. The matter is pending before the concerned
authorities. At this stage, in the instant matter, it
would not be proper to comment on the merit. In case the
petitioners have any further prayer, it has to be made
before the concerned authorities/forum.
2. We are not inclined to interfere, as the final
decision is yet to be taken. The writ petition is
dismissed and all pending applications stand disposed of.
3. However, all the questions are kept open.
W.P.(C)No.400/2018 :
1. As the matter is under active consideration of the
concerned authorities, at this stage we are not inclined
to make interference. The writ petition is dismissed and
all pending applications stand disposed of.
2. However, the questions can be agitated before the
appropriate authority. In case, any adverse orders are
passed, all the questions are kept open.
3. It is stated by Mr. Maninder Singh, learned
Additional Solicitor General of India, that Government of
India is taking decision in terms of the Regulations. Let
the matter be decided as expeditiously as possible.
4. Mr. Rakesh Dwivedi, learned senior counsel, has
submitted that the Government of India is bound to provide
hearing as per Section 10A of the Indian Medical Council
Act, 1956. This question can be urged before the
appropriate forum.
