PER : D.K. TYAGI, JUDICIAL MEMBER

This is assessee's appeal against the order of ld. CIT(A)-II, Surat

dated 30.11.2009.

2. At the time of hearing none appeared on behalf of the assessee despite

the fact that notice for hearing on 21.05.2012 was served upon the assessee and

on that date, at the request of the assessee, case was adjourned to 09.07.2012

i.e. today. It appears that assessee is not interested in prosecuting his appeal.

Therefore, following the decision of Hon'ble Delhi Tribunal in the case of CIT Vs.
I.T.A. No.844/Ahd/2010 2
A. Y. 2006-07

Multiplan India (Pvt.) Ltd. 38 ITD 320 (Delhi), the appeal of the assessee is

dismissed for non-prosecution.
